This notice contains important information about how we collect and process your personal data:
- Through your use of our website or our digital applications (Apps);
- By signing up for newsletters, competitions and other marketing activities either in-store or online;
- As an individual customer; or
- As a staff member or other representative of one of our business customers or suppliers.
It also contains information about your rights as a person whose information we process, and how you can complain if you have any concerns about what we are doing with your information. Any changes we make to this notice in the future will be posted on this page and, if appropriate, notified to you by email, so please check this page regularly.
Information about us
Bayertree Limited is the controller responsible for your personal data (referred to as "we", "us" or "our" in this privacy notice). Our registered office is at 58 Lambs Conduit Street, London, WC1N 3LW. Your personal data
Information provided to us by you or about you
You will provide some or all of the following information to us when you contact us, purchase goods from our shops or our website, request services offered by us in our shops, register a customer account online with us, use one of our Apps and/or sign up for newsletters and other marketing activities, either when speaking to staff in one of our shops or online:
- Your Identity and Contact Details - includes your name, email address, home postal address/billing address, delivery address (if different), and your contact telephone number;
- Your Payment Details - your bank details and payment card details, however your payment transactions will be encrypted by the acquiring bank so we will not retain any payment card details submitted by you;
- Your Profile Data - if you register a customer account online, this includes the profile you create to identify yourself when connecting to our website and Apps (including your username and password) and other data about purchases and your personal preferences; and
- Additional Personal Details - at your option, you can also provide additional personal information to us such as your date of birth, gender, passport number, product preferences and interests. This additional information would only be collected and stored by us for the purpose of analysing sales to help us understand and improve our business, for the purpose of any service requested by you, and for the purpose of any direct marketing which you may have expressly given your consent to.
Please note: we will combine and use the information we hold about you with the aim of delivering the best service we can, and so that you receive products and information from us in the way that you want. It is important that the personal data we hold about you is accurate and up to date, so please keep us informed if your personal data changes during your relationship with us.
If you are an employee or other representative of any of our business customers or suppliers, the same categories of information might be provided to us by you or about you by the business you represent. This notice applies to our processing of that information in the same way that it applies to information supplied to us directly.
We do not collect any categories of sensitive personal data (except in relation to employees). This website and our store policies assume that the customers we are interacting with are adults, so we do not knowingly collect data relating to children.
Information we collect when you interact with us
As you interact with our website, our communications (including our emails and mobile messages) and Apps, we also automatically collect usage and technical data about your equipment, browsing actions and patterns. We collect this data using cookies, server logs and other similar technologies (see the end of this page for more about cookies). We may also collect preference and other data that you choose to share with us.
Usage Data - includes details of products and services you have purchased from us in store and/or online, and information about how you use our website and our Apps and how you interact with our communications.
Technical Data includes your IP address, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform; information about your visit, including the full URL clickstream to, through and from our website, products you viewed or searched for, page response times, download errors, length of visits, page interaction information and methods used to browse away from the page; and, if you use a mobile device, the device type, a unique device identifier, mobile network information, operating system, browser type and time zone settings.
Preference Data - includes your preferred methods of communication, the topics you want to hear about, preferred stores or particular lines you are interested in, and other information you share to improve and individualise your shopping experience.
Other - we may also receive information from third parties we work closely with, such as online fashion retail platforms, delivery services, credit reference agencies and fraud prevention agencies.
What we use your personal data for
Data protection law in the UK allows us to collect, use, store and transfer personal information if we have one or more of the following grounds:
- To fulfil a contract with you; or
- Where necessary to comply with a legal or regulatory obligation; or
- Where necessary for our legitimate interests (or those of a third party), provided your interests and fundamental rights do not override those interests; or
- For other reasons where you have expressly consented.
We use your personal data to: process your order, including taking payment, supplying products and after-sales services such as cancellations and returns; verify identity and carry out credit checking; keep you updated on your order; process and administer your account; keep our records accurate and up to date; process retail export/tax-free shopping where you qualify and elect to use it; process competition, promotion or survey entries; allow you to use interactive features; analyse sales to understand and improve our business; create consolidated customer records and insights across the Oliver Spencer (Bayertree Ltd) business; administer and improve our website, communications and Apps; and keep our website and Apps safe and secure.
Automated processing and profiling
We use analytics and marketing tools that automatically process usage and technical data to help us understand how our website and communications perform, to measure and attribute our marketing, and to tailor the communications and recommendations you receive. These include the providers listed in the table at the end of this notice, such as Google, Klaviyo, Triple Whale and Rumvision. This may involve profiling, for example grouping customers by shared characteristics or predicting preferences, always in line with the lawful bases set out above and, where required, your consent. We do not make decisions that produce legal effects concerning you, or similarly significantly affect you, based solely on automated processing. You can object to profiling for direct marketing at any time (see Direct marketing and Your rights below).
Direct marketing
We need your consent for direct marketing communications. If you have expressly consented, we may use the information you have given us and which we collect when you interact with us to provide individualised communications about offers, in-store activities and topics you are interested in; deliver marketing, advertising and updates; measure and understand the effectiveness of advertising; decide which communications to send you; and make recommendations about goods or services that may interest you.

Cookies: with limited exceptions for cookies essential to the operation of our website, we need your consent for our use of cookies. You have the right to withdraw your consent; for more information contact us at info@oliverspencer.live.
Who we share your personal data with
We may share your information within the Oliver Spencer business and with selected third parties for the purposes above, for example: payment acquiring services; delivery and courier companies; credit reference and fraud prevention agencies; tax-free shopping service providers; third-party service providers that support our business and require access to our systems for maintenance or technical support; analytics and search engine providers; hosting and platform providers; and, where you have opted in, advertising and affiliate partners and communications platforms.
We require all third parties to respect the security of your personal data and to treat it in accordance with the law. They may only process your personal data in accordance with our instructions and not for their own purposes. From time to time we may ask if you would like to be contacted by other selected third parties, such as for a joint promotion; if you consent, that third party will be the data controller for the activity you consented to.
Links to other organisations
Our website, emails and Apps may contain links to and from websites of partner networks, advertisers and affiliates. These websites have their own privacy policies and we do not accept responsibility or liability for them. Please check these policies before you submit any personal data.
Opting out of marketing and preference updates
If you no longer wish to receive direct marketing from Oliver Spencer you can unsubscribe at any time using the link in our emails or the instructions in our mobile messages, or amend your preferences in the email preference centre. Please note that opting out of our Oliver Spencer email newsletters does not automatically opt you out of communications from our stores, and vice versa, so you may need to opt out of each separately. Security of your personal data
Our website, Apps and systems have appropriate security measures in place to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed, and all information you provide is stored on secure servers. Where you have a password, you are responsible for keeping it confidential; please choose a secure password and do not share it or re-use one from elsewhere. We recommend only connecting to secure, trusted wireless networks. If you receive an email purporting to be from Oliver Spencer asking for personal data, please do not respond but let us know so we can check whether it is genuine.
Outside the UK - data storage and transfer
Most of the data we collect from or about you will be processed and stored within the UK or other countries the UK government has determined to have adequate data protection safeguards (including the European Economic Area). We may transfer personal data to other countries only where necessary for our work with Oliver Spencer (Bayertree Ltd) and the third parties who help us, or to comply with a legal duty. Whenever we transfer your data outside the UK/EEA we ensure an adequate level of protection, for example through standard contractual clauses, binding corporate rules, or transfers to organisations covered by an approved international arrangement.
How long we keep your personal data
If you visit our website but are not a customer or supplier, we keep usage and technical data for only as long as we need it. If you receive newsletters, we keep your data for as long as we continue to communicate with you and delete it when it is no longer required. If you are an individual customer, we keep your data for as long as you are a customer and afterwards to respond to any questions, complaints or unresolved issues. If you represent a business customer or supplier, we keep your data for the duration of that relationship and afterwards as needed. In all cases we may retain some data to meet legal, accounting or reporting requirements, or for research or statistical purposes.
Your rights
You have the right to object to our use of your personal information, or to ask us to delete, remove or stop using it if there is no need for us to keep it. You can exercise your rights by emailing us at info@oliverspencer.live or by writing to Customer Services, 58 Lambs Conduit Street, London, WC1N 3LW, England. Your rights include: to request access to your personal data; to request correction; to request erasure; to object to processing based on legitimate interests; to request restriction of processing; to request transfer of your data; and to withdraw consent at any time.
We may need to request specific information to confirm your identity before responding, as a security measure. You will not have to pay a fee to access your personal data, and we try to respond to all requests within three months. You have the right to complain at any time to the Information Commissioner's Office (ICO), the UK supervisory authority for data protection (www.ico.org.uk), though we would appreciate the chance to address your concerns first.
