Acceptance of terms

By accessing or using this website you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use the site. We may update these terms from time to time; the version that applies to your order is the one published here when you place it. We recommend checking this page from time to time.

Eligibility

You must be at least 18 years old to place an order.

Orders and contract

Your order is an offer to buy. A binding contract is formed only when we dispatch the goods to you, or, for click & collect, when we hand them to you in store. We may decline any order for any reason and will not be liable for doing so. We may fulfil part of an order where only some items are available.

Pricing and payment

All prices include 20% VAT for UK orders. We accept all major credit and debit cards including American Express, as well as Apple Pay and Shop Pay. Klarna is available on international orders through Global-e, with UK availability coming soon. Occasionally an item may be mispriced or misdescribed; where this happens we are not obliged to supply it at the incorrect price and will either cancel and refund your order, or contact you to continue at the correct price.

Promotions and discount codes

Only one discount code may be used per order, and codes do not apply to items already reduced in a sale unless stated. Promotional prices must be claimed with the relevant code at checkout.

Delivery and click & collect

Delivery options, costs and timeframes are set out on our Delivery & Returns page and form part of these terms. For click & collect, the contract is formed when we hand the goods to you in store. If you do not collect within the period we communicate, we may cancel your order and refund you.

Cancellation and cooling-off

If you are a consumer in the UK or EU, under the Consumer Contracts Regulations 2013 you may cancel your order within 14 days of the day after you receive the goods, for any reason. To cancel, email info@oliverspencer.live, then return the goods within 14 days of cancelling, unworn and in resaleable condition. We will refund the price paid and the standard outbound delivery cost (we may reduce the refund to reflect any loss in value caused by handling beyond what is necessary to inspect the goods). This cooling-off right is separate from our standard returns policy and does not affect your statutory rights. For hygiene reasons, sealed grooming products once opened and underwear are excepted.

Faulty goods and your statutory rights

Nothing in these terms affects your statutory rights. Under the Consumer Rights Act 2015 goods must be of satisfactory quality, fit for purpose and as described. If they are not, you may be entitled to a repair, replacement or refund, including a full refund if you return a faulty item within 30 days of receipt.

Gift cards

Oliver Spencer digital e-gift cards are delivered by email and redeemable online. They are valid for 12 months from purchase, cannot be exchanged for cash and are non-refundable. Lost or stolen gift cards cannot be replaced.

Pre-orders

Where an item is offered for pre-order, the expected dispatch window is shown on the product page. You may cancel a pre-order for a full refund at any time before it is dispatched.

Availability

All goods are subject to availability. If we cannot supply an item you have paid for, we will refund you as soon as possible.

Intellectual property

All intellectual property on this website, including trademarks, designs, images and text, is owned by or licensed to Oliver Spencer and may not be copied, reproduced or used for commercial purposes without our permission.

Text and data mining and artificial intelligence

You may not use any content on this website, including product descriptions, images, photography and other materials, for text and data mining, or to train, develop or improve any machine learning or artificial intelligence system, without our express written permission. Oliver Spencer expressly reserves all rights in respect of text and data mining of the content on this website, including any reservation permitted under applicable UK and EU law. Automated scraping, harvesting or bulk downloading of the website or its content is prohibited.

Acceptable use

You agree to use the website lawfully and not to disrupt it, impair its performance, corrupt its content, or attempt to access secured areas or data without authorisation.

Limitation of liability

We will not be liable for indirect, special or consequential loss, including loss of business, revenue, profit or data arising from your use of the website. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded by law.

Events outside our control

We are not liable for any delay or failure to perform caused by events beyond our reasonable control.

Third-party links

The website may contain links to websites operated by others. We do not control these sites and take no responsibility for their content. Inclusion of a link does not imply endorsement.

Severance

If any provision of these terms is held to be invalid or unenforceable, it shall be struck out and the remaining provisions shall remain in force.

Governing law and jurisdiction

These terms are governed by the laws of England and are subject to the exclusive jurisdiction of the English courts.
